OVERSEAS BUYER GUIDELINES:
Overseas Buyers should ensure that the country to which the items are destined:-
• holds no import restrictions on the goods to be purchased;
• has no import licence restrictions or a restriction on currency allocation;
• has no prolonged inspection procedure which might cause excess delay or refusal in allowing your goods to be imported.
Overseas Buyers will receive a fully descriptive invoice in order that they may arrange payment as soon as possible with the Company`s bank.
Overseas Buyers should employ a suitable freight forwarding organisation. Please note that many of the machinery removal companies in the United Kingdom are not necessarily freight forwarders. The [Seller and/or Company] will be pleased to advise accordingly.
The Company makes no representation and accepts no liability whatsoever to any Buyer in respect of the issuance or validity of any exportation or importation permits or the existence and exercise of exportation or importation regulations or any compulsory purchasing regimes.
VAT RULES FOR EXPORT:
All overseas Buyers (EU and non EU) will be charged VAT at the current rate on each Lot purchased. This will be refunded to the overseas Buyer as soon as the Seller receives a copy of the bill of lading/certificate of shipment/CMR as proof of export, providing this documentation is received within 3 months of the sale date and within one month of the date of export. The Auctioneer Ltd is unable to refund the VAT on the Buyer’s Premium to non EU countries. All paperwork will be checked for validity.

PAYMENTS: Payment shall be made by DEBIT CARD(CARD PRESENT) or TRANSFER (Credit cards may be used for identification purposes only)

CONDITIONS OF SALE: All lots are offered subject to our normal conditions

DEPOSITS:
If requested by the Auctioneers buyers shall pay a deposit of 25% (plus VAT) of the purchase price for each Lot purchased as requested by the Company pursuant to the General Conditions and these Special Conditions. The company reserve the right to take a deposit by way of a credit/ debit card payment from the card presented for registration if the payment terms are not complied with.

COLLECTION OF PURCHASED LOTS: All lots must be collected within 3 working days of the sale closing unless otherwise agreed/discussed with the Auctioneers.
No loading facilities can be guaranteed at the sale site, so Purchasers are advised to make their own lifting/loading arrangements.

SAFETY REGULATIONS: Purchasers must satisfy themselves prior to bidding that the items offered comply with all currently applicable Health & Safety, CE Certification or Road Traffic regulations concerning their use, alternatively they shall undertake all necessary works required in order to comply before usage. The Vendors or the Auctioneer's shall not give or imply any guarantee that the items offered conform to current legislation. In addition, where applicable the purchaser shall ensure that they acquire the manufacturer's instructions concerning the operation of any equipment and subsequently agree to operate the machinery in accordance with the manufacturer's recommendations. No liability will rest with the Auctioneers or The Vendor with regard to this matter.

CONDITIONS OF SALE: All lots are offered subject to our normal conditions of sale, and any additional conditions contained within this catalogue, full copies of which are available upon request.
All items will be "Sold As Seen" with no warranty given or implied

NOTE: Auctioneer's Margin Scheme: Items that are sold exclusive of VAT, as identified at the time of sale, are to be sold in accordance with the "Auctioneer's Margin Scheme". GENERAL TERMS & CONDITIONS

1. DESCRIPTION : No warranty is given or implied by the description in the catalogue. The genuineness or authenticity of any lot is not guaranteed, but EACH LOT IS SOLD IN IT’S CONDITION AT THE TIME OF SALE WITH ALL FAULTS, DEFECTS, IMPERFECTIONS AND ERRORS OF DESCRIPTION (IF ANY) and shall be “sold as seen”.

2. VARIATION OF LOTS : The Auctioneers reserve the right to withdraw, consolidate or divide any lot or lots or to submit them in any order they may deem desirable.

3. BIDDING : The conduct of the sale shall be at the Auctioneer`s sole discretion and the Auctioneers reserve the right to refuse any bids without giving any reason. If any dispute of whatsoever nature relating to a bid shall arise, such dispute shall be determined by the Auctioneers in their absolute discretion and whose decision shall be final and binding on all parties.
Each bidder must register prior to submitting any bids in On-Line sales. The Auctioneer Ltd reserves the right to reject any registration at its sole discretion.
The Vendor and the Auctioneers reserve the right to fix a reserve price for any lot.The Auctioneer's reserve the right to bid on behalf of the vendor below the reserve price if necessary.
No bid may be withdrawn after the close of bidding.
The highest bidder for each lot at the close of bidding shall be the Buyer, subject to approval by the Auctioneers and the Vendor. The Sale Price is exclusive of the buyer’s premium and VAT. The highest bid at the close of bidding subject to approval by the Auctioneers and Vendor also marks a conclusion of a contract of sale between the Vendor and the Buyer.
4. PAYMENT : AFTER A LOT IS SOLD IT SHALL BE AT THE PURCHASER’S RISK and it must be expressly understood that the Auctioneers will not be responsible for it’s safe custody. The remainder of the purchase money shall be paid before delivery and if one person purchases two or more lots the price of all must be paid before the delivery of any items. The Auctioneers reserve the right to make an allowance in proportion to the purchase money of such lot for the whole or any portion of a lot not delivered. Purchasers shall have no right to avail themselves of any set off or other plea against the Auctioneers or the Vendor for non payment of the purchase money.

5. DELIVERY & CLEARANCE : No lot will be delivered during the time of the sale and no transfer of lots will be permitted. Lots will only be delivered by the sale porter in exchange for the Auctioneer’s delivery order. ALL LOTS TO BE PAID FOR IMMEDIATELY 
6. DISPUTES : The Auctioneers shall be sole arbitrators in any matters of 
dispute arising during or after the sale.

7. INDEMNITIES & PENALTIES : Purchasers shall pay for any damage done by themselves or their agents during removal of their lots, the amount of such damage to be assessed by the Auctioneers. As the Auctioneers act only as Agents for the Vendor they shall not be held personally responsible for any default on the part of either Vendor or Purchaser, nor shall be held responsible for damage or loss by accident or fire. ANY ASSISTANCE WITH LOADING or 
UNLOADING OF GOODS THAT IS GIVEN BY AUCTION STAFF IS AT THE OWNER’S RISK.

8. TAKING CHARGE OF LOTS : No undertaking of the Auctioneers or their servants nor of the servants or employees of the Vendor to take charge of the lots after the sale, or to forward them to their destination, shall be held to impose upon the Auctioneers or the Vendor any legal obligation or vitiate any of the foregoing conditions.

9. FAILURE TO COMPLY WITH CONDITIONS : Purchasers failing to comply with the above conditions shall forfeit their deposit money. Any lots uncleared by the specified time will be removed and resold at the expense of the Purchaser and any deficiency arising from such resale and all losses and charges incident thereto shall be made good by him.

10. RESERVE PRICE: Some lots are put up for sale subject to a reserve price, placed by the Vendors.
11. NO CHEQUES accepted.

12: THIRD PARTY LIABILITY: All persons entering on to the Auction premises at any time shall be deemed to be there at their own risk and shall have no claim against the Auctioneers in respect of any accident or injury that may occur, however caused.The Auctioneer or the Vendor shall not accept legal resposibility for loss of life, limb or any injury however caused. Visitors shall be responsible for their own actions at all times. Any damage occassioned by any visitor will be paid for in full at full replacement cost. 
The Auctioneers suggests that any visitors effect their own suitable insurance to cover their attendance at the sale. 

13: ACCOUNTS: Purchasers or their agents must check their invoices before leaving the premises. The Auctioneers cannot be held responsible for any errors in accounts unless they are notified of any such errors on the day of sale and before lots are removed from the premises.

14: PURCHASED VEHICLES: Purchasers must check all available documentation & chassis numbers before bidding on any vehicles offered. A declaration & change of ownership form must be completed & signed by the purchaser before leaving the premises. Any discrepancies concerning chassis numbers or any other relevant fact must be notified to the Auctioneers before the vehicle leaves the sale premises. DRIVING LICENSE required as proof of new keeper details. 
All vehicles shall be “sold as seen” no warranty given or implied. No reliance whatsoever should be placed on the mileage of any vehicle sold.

15: VAT: VAT shall be charged on all lots at the appropriate rate unless stated to the contrary by the Auctioneer at the time of sale. Where items are purchased for export arrangements concerning the refund of VAT must be made with the Auctioneers before the commencement of the sale. To qualify for VAT refunds all necessary criterior must be met (see special VAT rules at the saleground) in accordance with Government statutes.



16: LEGISLATION CONCERNING USE OF PURCHASED GOODS: Purchasers shall 
satisfy themselves prior to purchase that items offered for sale comply with any
current legislation concerning their use (ie Health & Safety Law, COSHH, Road Traffic Acts, 
CE Marking etc) or they shall undertake to ensure that all necessary repairs/provision of 
guarding or any other required procedure is carried out prior to any machinery or lot
being used. No responsibility shall rest with the Auctioneers or the Vendors in 
connection with this matter.

17. ADDITIONAL RELEVANT CONDITIONS:

All lots are sold to intending purchasers on the following terms, and no person in 
the employment of or acting otherwise as agent of the Auctioneers or purporting 
to do so, has the authority to impose any other conditions or to vary these terms 
in any way whatsoever. Previous dealings between the Auctioneers and any bidder 
shall not vary or replace these terms or be deemed in any circumstances whatsoever 
to do so. The making of any bid to the Auctioneers shall be conclusive evidence before 
any court or arbitrator that these terms apply.

a) The intending purchaser acknowledges that immediately before making any bid to the Auctioneers he has expressly represented and warrented that he or she is not insolvent and has not committed any act of bankruptcy, or if acting for a company, knows of no circumstances which would entitle any debenture holder or secured creditor to appoint a receiver, to petition for winding up of the company or exercise any other rights over or against the company’s assets.

b) Lots the subject of any successful bid shall remain the property of the 
Vendor until such time as the Bidder shall have paid to the Auctioneers the full bid price and completion of the sale shall be conditional upon such payment but shall be at the risk of the Bidder immediately upon the fall of the hammer. The Bidder acknowledges that he is in possession of the lot solely as bailee for the Vendor until such time as the full price thereof is paid to the Auctioneers.

c) The intending Purchaser’s right to possession of the goods shall cease if he,not being a company, commits an available act of bankruptcy or if he, being a company, does anything or fails to do anything which would entitle a receiver to take possession of any assets or which would entitle any person to present a petition for winding-up, or in any case if the Auctioneers have good and sufficient reason to believe the intending purchaser is or will be unable to pay the price or is in breach of the warranty in sub clause (a) of this clause, or if the intending purchaser shall cease or threaten to cease to carry on business.

d) The Auctioneers may for the purpose of recovery of any goods enter upon 
any premises where they are stored or kept or where they are reasonably thought to be stored or kept and may repossess the same.

e) Deposits; Where a deposit is taken it is deemed to be paid as a part payment against a purchase invoice. In the event of non payment of of any outstanding balance the deposit monies shall be offset against the cost of reselling the goods, VAT on the goods purchased, storage and any reasonable other associated costs together with any shortfall between the purchase price and the resale price achieved. Any additional balance, if any, shall be repaid to the Purchaser within 3 months of all relevant items having been resold.

Any Visitor/Purchaser shall also be bound by any additional terms or conditions that may be stated within the sale catalogue
